LV man wins $100,000 settlement from trooper

A Las Vegas man who accused a Nevada Highway Patrol trooper of beating him up before an arrest has won a $100,000 settlement, a court document said.
Russell Duensing accused Trooper Douglas Webster of hitting him with a baton when he attempted to flee the scene of a 1993 incident. Duensing was cited for resisting arrest and driving while intoxicated.
Webster maintained that Duensing was injured when he struggled to wrestle the baton out of the trooper's hand. When the trooper let go, he said, the police tool snapped back into Duensing's face.
In court papers filed Monday, Duensing's attorney Cal Potter agreed to the state's settlement offer of $100,000.
NHP originally was named as a defendant in the lawsuit, but the agency was dismissed from the suit because a state cannot be sued in federal court.
