That's because The M Resort has filed a petition in that infamous Clean Water Coalition case, hoping to amend its original complaint to ensure that the local government members of the moribund board return the fees to those who paid them. The case changed the entire budget dynamic in Carson City when the state Supreme Court ruled lawmakers and the governor illegally took the CWC's $62 million last year to balance the budget. The budget stalemate was swiftly settled after Gov. Brian Sandoval decided $600 million actually could be at risk.
Now, based on representations from at least a couple of local governments that they think they are entitled to keep their share of the CWC money instead of paying back The M and others, the resort has filed a new court document to ask for leave to amend its original complaint to prevent this from happening. They paid into the CWC for a specific pipeline project, now scuttled, and want their money back. What a shocking notion. The governments, facing their own financial troubles, wouldn't try to keep their share of the $62 million, would they? That would be so out of character.

This issue has to do only with the local governments in Clark County and those who paid the original rate, not the state -- the CWC sued before any money was transferred.
The $62 million you are suggesting the governor might keep won't be kept by the state, as it was never paid to the state in the first place.
