Any examples in the last 30 years of a suit like this being successful???
Great example of executive direction: go sue the federal government, just like fourteen other (unnamed) AG's are doing, because it's unconstitutional, and against our interests, and so on. And because I said so, even if I didn't offer any specifics - YOU fill in the blanks!

The governor cites Nevada Revised Statute 228.170(1) as his authority. But attorneys general in common law jurisdictions (and Nevada is one) get their authority from constitutions AND common law, and a mere statute cannot rob the attorney general of her independence under the separation of powers. Only a constitutional amendment can do that.

DennisMyers....In Nevada, only a Nevada Court can declare a NRS as unconstitutional.
The AG can not ignore a NRS because they think it is unconstitutional.
If they believe it is unconstitutional they they can file suit and ask a Nevada Court to declare it unconstitutional.
Until a court says otherwise, all NRS are constitutional.
It is not like with the US President that can declare a law or part of a law to be unconsitutional and then order the executive branch to ignore it and then somebody has file suit to get the courts to tell the President that it is constitutional.
So NRS says, " Whenever the Governor directs or when, in the opinion of the Attorney General, to protect and secure the interest of the State it is necessary that a suit be commenced or defended in any federal or state court, the Attorney General shall commence the action or make the defense."
Sgtrock, re-read the statue, the Attorney General herself is using it against Gibbons, this frivolous lawsuit that Gibbons is trying to bully our Attorney General into to filing, is all for Gibbons publicity, because he thinks, he is really going to win the up coming election. Please do not let Gibbons fool you, he could care less about our Great State and it's people...
That NRS is very clear.

"Whenever the Governor directs...." You know the governor......directs.....
" Or when" you know the word "or"...is not equal to the word " and"
So whenever the Governor directs...or....(not and) AG has the opinion.....
"that a suit be commenced " ....you know as in lawsuit...be filed.
"the Attorney General shall commence the action "
You know as in the Attorney General.....shall ( not could...not maybe...not perhaps) commence the action...as in file the lawsuit.
That NRS is very clear....bright....focused....one would have to be totally blind or corrupt not to understand its verbatium reading.

Rock...what if the AG feels the suit is without merit. I don't believe Gibbons is an attorney much less a constitutional law scholar. The case has to have a legal theory. If she feels it to be frivolous and without merit she won't file regardless of what Gibbons says.
Masto cannot be forced, by the governor, to sue no matter what the ding dong and Congressman ding dong thinks.

"Sick" is knowing that my taxes support the salary, lifestyle, and perks of an utterly incompetent, immoral, philandering fool like you.
