What am I missing? How can it be labeled justifiable? And then conclude that it was caused by a medical condition?Maybe the officers should be educated on the signs and symptoms of a petit mal seizure! I.m confused!
You're confused alright. First of all, it was not labeled justifiable, it was determined to by the jury to be excusable (there is a difference, look up the law). This officer was educated on the post-symptoms of seizure, but the suspect kept started fighting him and wouldnt stop (not a sympton of post-seizure behavior.). Even after getting tasered 4 times, the suspect kept fighting. Another medical doctor witnessed the whole thing and came up with the same conclusion, the trooper had no choice. Very tragic for the victims family and for the trooper. This Dr. Rich must have had bigger problems than a siezure disorder.
